Gesser OS

Terms of Service

Effective October 12, 2026

These terms are an agreement between Gesser Services LLC ("Gesser OS", "we", "us") and the business that creates an account ("you"). Gesser OS is software for service contractors: leads, scheduling, work orders, estimates, invoices, a customer portal, and an AI assistant that answers calls and messages for your business. By creating an account you accept these terms.

1. Your account

You must be at least 18 and able to act for the business you register. You are responsible for everyone you invite to your workspace and for what they do in it.

Owners and admins must use two-step verification. Keep your password and your authenticator safe; tell us right away if you think someone else has access.

2. Free trial

If a free trial is offered, its length and whether a card is required are shown when you sign up. When the trial ends, your workspace is locked until you choose a paid plan. You can download your data while it is locked.

We may limit what is included in a trial, such as a phone number or call minutes.

3. Plans, billing and taxes

Paid plans are billed monthly in advance, in US dollars, through Stripe. Your subscription renews each month until you cancel. The price and what each plan includes are shown on the billing screen before you pay.

Some features have usage that we pay for on your behalf, such as phone numbers, call minutes, text messages and AI usage. Plans may include a set amount; we will tell you before any charge beyond your plan applies.

If we change the price of your plan, we will give you at least 30 days' notice by email. Prices do not include taxes; you are responsible for any that apply.

4. Failed payments

If a payment fails, Stripe retries it. Your workspace keeps working for 7 days after the missed payment. After that it is locked, and the assistant stops answering your web chat and messages, until the balance is paid.

A locked workspace is not deleted. See the Refund and Cancellation Policy for what happens to your data.

5. Cancelling

You can cancel at any time from Settings, Billing. Cancellation takes effect at the end of the billing period you already paid for. Refunds are covered in the Refund and Cancellation Policy.

We may suspend or close an account that breaks these terms, puts other customers at risk, or is used for anything unlawful. Where we reasonably can, we will warn you first.

6. Your data and your customers' data

You own the information you and your customers put into your workspace. You give us permission to store and process it only to provide the service to you.

For your customers' personal information we act as your service provider: we handle it on your instructions, and you are the one responsible for having the right to collect and use it. The Privacy Policy explains how.

You can export your data at any time, including while your workspace is locked.

7. Calls, recordings and the AI assistant

The assistant answers calls and messages in your business's name. Calls may be recorded and transcribed, and the assistant tells callers that calls may be recorded. You are responsible for following the call-recording and consumer-protection laws that apply to your business and your callers.

The assistant is software. It can misunderstand a caller, miss a detail or give an incomplete answer. It does not diagnose equipment, and it is not a substitute for you reviewing your leads, appointments and messages. Do not rely on it as your only way to receive emergency requests.

8. Text messages and email

You may only text or email people who gave you permission, and you must honor opt-outs. In the United States, text messaging requires registering your business with the carriers (A2P 10DLC); text features are not available until that registration is approved.

You are the sender of the messages that go out in your business's name. You must not use the service to send spam or unlawful messages.

9. Connecting other apps and AI tools

You can connect third-party services, including your own AI assistant, to your workspace. When you approve a connection, that app can read and change data within the permissions you grant. You are responsible for the apps you connect; their own terms and privacy practices apply to what they do with your data.

You can disconnect an app or pause all AI access at any time in Settings.

10. Acceptable use

  • Do not break the law or help anyone else do so.
  • Do not try to access another business's data or get around security or usage limits.
  • Do not resell the service or use it to build a competing product.
  • Do not upload malicious code or content you have no right to use.

11. Our software

Gesser OS, its design and its code belong to us. We give you a limited right to use it for your business while your account is active. If you send us feedback, we may use it without owing you anything.

12. Availability and no guarantee of results

We work to keep the service running and your data safe, but the service is provided "as is" and "as available". It depends on other companies' networks and services, and it may be interrupted.

We do not promise any business result: not a number of leads, booked jobs, answered calls, search ranking or revenue. To the extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

13. Limit of liability

To the extent the law allows, we are not liable for lost profits, lost business, missed calls or leads, or any indirect or consequential damages. Our total liability for any claim about the service is limited to what you paid us for it in the 3 months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law.

14. Your responsibility to us

If someone brings a claim against us because of how you used the service — for example, messages you sent without permission, or the work you did for your customers — you will cover the reasonable costs of that claim.

15. Changes to these terms

We may update these terms. If a change is significant we will tell you by email or in the app at least 30 days before it applies. Continuing to use the service after that date means you accept the new terms.

16. Governing law

These terms are governed by the laws of the State of New Jersey. Any dispute will be brought in the state or federal courts located in Atlantic County, New Jersey.
